General Artifact Policy

What
This Artifact Policy Covers
- This
policy covers how Jackson Galleries treats artifacts submitted
to Jackson Galleries for: sale, consignment, trade, evaluation,
appraisal, grading, or any other situation arising in which Jackson
Galleries is not the owner of the items in question.
- This
Policy is in addition to, and in some instances overrides, our
General Terms and Conditions.
- This
policy does not apply to the practices of companies that Jackson
Galleries does not own or control, or to people that Jackson
Galleries does not employ or manage.
Information
Collection and Use
General
- Jackson Galleries
collects information including photographs on any artifacts submitted
when you use Jackson Galleries products or services. Jackson
Galleries may combine information about you that we have with
information we obtain from business partners or other companies.
This collected information my be used later to prove condition
of receipt of any item with a damage claim.
- When
you submit any items we ask for information such as origin information
specific to the item(s) submitted. For some services we may also
ask for your address, phone number, Credit Card number, and other
contact information. Once you use Jackson Galleries products
or services, you are not anonymous to us.
- Jackson
Galleries collects information about your transactions with us,
including information about your use of products and services
that we offer.
- Jackson Galleries
automatically receives and records your contact information at
the time of receipt of item(s) submitted.
- Jackson
Galleries uses information for the following general purposes:
to customize the advertising and content you see, fulfill your
requests for products and services, improve our services, contact
you, conduct research, and provide anonymous reporting for internal
and external clients.

Accuracy
of Evaluations
- Jackson
Galleries assesses to the best of its ability, through the usage
of current scientific methods
and independent testing
(when requested and purchased) to determine the veracity of an
evaluation of authenticity or inauthenticity, the accuracy of
its evaluations within the financial constraints of the cost
of evaluation.
- In
the case of an inconclusive result, due in part or in whole to
sample contamination, cleaning, restoration, artificial coatings,
or other unforeseen circumstance no evaluation will be recorded
and the client will be refunded the price of service less return
S&H and a second opinion from another qualified examiner
will be recommended.
Evaluations
- Jackson Galleries will examine any item of purported antiquity at the request of the owner.
- Jackson Galleries will reasonably attempt to secure for storage the item(s) submitted to prevent damage or loss.
- Jackson Galleries will reasonably package and return ship the item(s) upon completion of the evaluation(s) in a manner befitting the specific item(s) within the financial constraints of the Return Shipping and Handling fee paid by the client.

Items
we will refuse
Jackson Galleries
will refuse to evaluate, broker, or purchase and notify authorities
if necessary upon receipt of:
- Items
from a provable funerary context, in accordance with applicable
law
- Human Remains - in part or in whole - regardless of origin or legality of possession
- Hazardous
materials including items with a possible Biological-Hazard or
liquids.
- Items
containing in part or in whole restricted or illegal substances
- Illegally
imported goods
- Stolen
Goods
Laws
- Jackson
Galleries operates in accordance with, and sometimes in cooperation
with: International, Federal, State, and Local: Treaties, Laws,
Ordinances, and Agencies
Confidentiality
and Security
- We
limit access to information about the results of evaluations
to employees and trusted entities who we believe reasonably need
to come into contact with that information to provide products
or services to you or in order to do their jobs.
- We
have physical, electronic, and procedural safeguards that comply
with federal regulations to protect personal information about
you.
- Jackson
Galleries maintains a secure location with 24/7 Armed Response
contractors authorized to use lethal force.
Evaluation Warranty
- Jackson
Galleries makes no guarantee that independent examination will
concur with the results of a Jackson Galleries evaluation. Currently
there is no governing body or standards of practices with which
to govern or gauge the accuracy of an authentication evaluation.
Limitation
of Liability
JACKSON
GALLERIES DOES NOT WARRANT THAT ANY SERVICES PERFORMED WILL
MEET THE EXPECTATIONS OF RESULTS THE CLIENT MAY HAVE. IF
YOUR USE OF OUR SERVICES RESULTS IN ANY COSTS OR EXPENSES,
INCLUDING, WITHOUT LIMITATION, THE NEED FOR REFUND ISSUANCE TO A BUYER ON YOUR PART
DUE TO A CONFLICTING EVALUATION RESULT,
JACKSON GALLERIES SHALL NOT BE RESPONSIBLE FOR THOSE COSTS
OR EXPENSES.
THE RESULTS OF ANY EVALUATIONS OR SERVICES
ARE PROVIDED ON AN "AS IS" AND "AT YOUR OWN RISK"
BASIS WITHOUT ANY WARRANTIES OF ANY KIND. JACKSON GALLERIES,
TO THE FULLEST EXTENT PERMITTED BY LAW, DISCLAIMS ALL WARRANTIES,
INCLUDING THE WARRANTY OF MERCHANTABILITY, NON-INFRINGEMENT OF
THIRD PARTIES RIGHTS, AND THE WARRANTY OF FITNESS FOR PARTICULAR
PURPOSE. ALTHOUGH JACKSON GALLERIES STRIVES TO PROVIDE THOROUGH
AND ACCURATE EVALUATIONS, WE MAKE NO WARRANTIES ABOUT THE ACCURACY,
RELIABILITY, COMPLETENESS, OR TIMELINESS OF EXAMINATION.
JACKSON
GALLERIES DOES NOT MAKE ANY WARRANTIES AS TO THE RESULT OR OUTCOME
OF USING SERVICES DESCRIBED OR PROPERLY FOLLOWING ANY INSTRUCTIONS,
RECOMMENDATIONS, OR DIRECTIONS CONTAINED IN THE SITE MATERIAL.
Changes
to this Policy
- Jackson
Galleries may update this policy. We will notify you about significant
changes in the way we treat items submitted by sending a notice
to the primary email address specified in your contact information
or by placing a prominent notice on our site.

- Jackson Galleries is a fair and reasonable company. If you have an issue with Jackson Galleries, please contact Jackson Galleries and we will resolve it within our stated policies.
